Learning objectives:
The seminar will address practical problems for cross-border estates. Participants will get familiar with the EU Succession Regulation and learn how to apply it in legal practice. A focus of the seminar will be the European Certificate of Succession and how to issue it. Participants will discuss experiences and best practice.
Short description of the programme:
The seminar will address the following practical issues:
- EU Succession Regulation: scope, jurisdiction and applicable law
- Habitual residence: how is the habitual residence of the deceased person to be assessed?
- Reserved portion and choice of law
- European Certificate of Succession: issuance and interplay with national certificates
- Recent CJEU case: major case law on the EU Succession Regulation and its implications for legal practice will be presented

Participation:
