PRACTICAL INFORMATION

Description: 

Aim of the course is to offer an update on the topic of Freedom of expression, as laid down in Article 21 of the Italian Constitution and, at European level, in Article 10 of the Convention on Human Rights and Article 11 of the Charter of Fundamental Rights of the European Union.Particular attention will be devoted to the role of the judge facing the conflict between the protection of freedom of expression and other equivalent rights, such as personality rights, the right to protection of personal data and the right to intellectual property.The most significant cases decided by the European Court of Human Rights will be presented and analyzed to assess how the standards and criteria identified by the Court in Strasbourg can represent a reference for the national judge, when it comes to balancing fundamental rights.Furthermore, one of the four sessions will be dedicated to hate speech and the forms of contrast implemented by the national and European legislators. Focus will be mainly on online communication and also in this session the analysis will take into account the jurisprudence of the Strasbourg Court as well as indications provided by the EU Court of Justice.This 3-day event (4 sessions) for judges and prosecutors foresees lectures, a debate, workshops and a round table.

Participation:

Upon invitation by EJTN, participants register via EJTN online  platform to which they receive access.
