Course Description
The problem of “shadow justice” (or parallel justice) has become apparent to varying degrees in Germany. From some larger cities, there are findings on the structure of an internal conflict resolution, which operates in secret, ignores the state’s legal system, and expresses another standard of values and a different system of norms. Individual rights are restricted, the state's decision-making monopoly is disregarded, the fundamental values of the constitution are ignored and the execution of criminal or other legal proceedings is complicated. In 2014, the Federal Ministers of Justice established a joint task group with the aim of exchanging experiences in this area beyond the borders of the federate states (Bundesländer), possibly involving external expertise, developing a shared result and identifying solutions. The conference is addressed to judges of ordinary jurisdiction as well as to state prosecutors. It is intended to inform about the experiences with those structures, to illuminate the cultural and / or ethnic background and to point out the borderline between desired out-of-court mediation and non-acceptable conflict resolution mechanisms.
