Course Description

The course aims to examine the three systems of protection of fundamental rights (Constitution, European Convention on Human Rights and Charter of Fundamental Rights of the Union) and  guide the participant through possible ways of resolving the conflict between domestic law, European Union law and the ECHR. Specific attention will be devoted to interpretation in conformity with the law, to the preliminary ruling on constitutional legitimacy, to the preliminary ruling of the Court of Justice and to the disapplication of domestic law that conflicts with EU law.
